Pursuant to the requirements of Rule 4.1(E) of the Ohio Rules of Criminal Procedure, the court hereby promulgates and adopts the following fee/fine schedule for waiverable violations of the Codified Ordinances of the City of Cleveland and the Ohio Revised Code. In criminal cases having multiple charges, all costs required by Ohio Revised Code Sections 2743.70 and 2949.09(A)(1) et seq. shall be assessed to the case and not to each charge. In addition, the court shall charge a twenty dollar ($20.00) filing fee as court costs for each offense charged under a criminal or traffic case number. Pursuant to Rule 13(B)(6) of the Ohio Traffic Rules, a second moving traffic offense within a twelve (12) month period cannot be waived. Any waiverable violation resulting in an accident cannot be waived.
It is further ordered that the Clerk of Court prominently post a current waiver schedule at the counter in the Clerk of Court’s office where these waivers are paid.
In the event that a person accused of an offense contained in this schedule should appear to pay the waiver but does not sign a guilty plea and waiver of trial, said offense shall be scheduled immediately for arraignment, and the tendered waiver shall not be accepted.
The alleged offender shall be assigned a court date upon his or her request. Additionally, all offenses not listed in said waiverable fine schedule shall require the defendant to appear in open court to answer to the complaint.
