1. Bond Set by Judge
   
   1. All residents of the jurisdiction of this court shall be eligible for personal bond in misdemeanor cases at the discretion of a judge or magistrate.
   2. Non-residents of the jurisdiction having substantial ties to this community (i.e. an extensive and ongoing employment history, current enrollment in a local educational institution) shall also be eligible for personal bond in misdemeanor cases at the discretion of a judge or magistrate.
   3. The judge or magistrate may deny personal bond to an individual if any of the following pertain:
      
      1. the alleged offense involved physical violence, child enticement, or inappropriate sexual conduct or contact;
      2. the alleged offender has a history of past failures to appear for court or is a habitual offender (three or more no-shows on one case or three or more outstanding unrelated cases which are not minor misdemeanors);
      3. three or more first degree misdemeanor charges arising out of the same offense
      4. the physical, mental, or emotional condition of the alleged offender poses an apparent danger to said person or to others if he or she is released.
2. Bond Set by Clerk
   
   1. Upon the processing of an arrest, the Clerk of Court or a duly authorized deputy clerk may set bond according to the schedule below. The clerk shall not set a bond in the cases listed above in A.3.
   2. The nature and degree of the offense shall determine the bond amount used. When two or more offenses, not exceeding first degree misdemeanors, arise out of the same incident only the higher bond amount shall be applied.

   Specific Offense Schedule 1. Aggravated Disorderly Conduct- Personal Bond 2. Child Endangerment- $1,500.00 3. DUI (OVI)- $2,500.00 4. Fleeing & Eluding- $1,500.00 5. Petty Theft- $1,000.00 6. Public Indecency- $500.00 7. Resisting Arrest- $750.00 8. Solicitation- $1,000.00 9. Vandalism of Vacant Structure- $2,000.00

4. Additional considerations
   1. If defendant is only charged with minor misdemeanor offenses, including traffic offenses, then Local Rule 4.01(K) or Local Rule 5.01(G) shall apply and the defendant shall be processed pursuant to that rule and released.
   2. For purposes of this schedule, a history of failure to appear shall be established by an offender’s non-appearance at any scheduled hearing on a criminal or traffic matter pending before this court, unless leave is granted or good cause for the non-appearance shown (Rule 46(D) of the Ohio Rules of Criminal Procedure).  In such instances, a new bond shall be set by the court at the time it issues a capias or other process ordering the offender’s arrest.
   3. When bond is denied or not posted, an initial appearance shall be scheduled before the appropriate particular sessions judge or magistrate on the next available court date following the filing of the charge(s) with the Clerk of Court or the defendant’s arrest on an outstanding warrant or capias.

Pursuant to the requirements of Rule 4.1(E) of the Ohio Rules of Criminal Procedure, the court hereby promulgates and adopts the following fee/fine schedule for waiverable violations of the Codified Ordinances of the City of Cleveland and the Ohio Revised Code.  In criminal cases having multiple charges, all costs required by Ohio Revised Code Sections 2743.70 and 2949.09(A)(1) et seq. shall be assessed to the case and not to each charge.  In addition, the court shall charge a twenty dollar ($20.00) filing fee as court costs for each offense charged under a criminal or traffic case number.  Pursuant to Rule 13(B)(6) of the Ohio Traffic Rules, a second moving traffic offense within a twelve (12) month period cannot be waived.  Any waiverable violation resulting in an accident cannot be waived.

It is further ordered that the Clerk of Court prominently post a current waiver schedule at the counter in the Clerk of Court’s office where these waivers are paid.

In the event that a person accused of an offense contained in this schedule should appear to pay the waiver but does not sign a guilty plea and waiver of trial, said offense shall be scheduled immediately for arraignment, and the tendered waiver shall not be accepted.

The alleged offender shall be assigned a court date upon his or her request.  Additionally, all offenses not listed in said waiverable fine schedule shall require the defendant to appear in open court to answer to the complaint.

SECURITY SCHEDULE FOR WRITTEN PLEAS

OF GUILTY IN ABSENTIA ON NON-WAIVERABLE OFFENSES

Pursuant to the requirements of Rule 4 (A) of the Ohio Traffic Rules and the provisions of Local Rule 5.06 (B), the court hereby promulgates and adopts the following security schedule for non-waiverable violations of the Codified Ordinances of the City of Cleveland and the Ohio Revised Code.  In cases having multiple charges, the deposit of security shall be based upon the highest degree offense charged, not for each charge.

The Clerk of Court shall prominently post a current security schedule at the counter in the Clerk of Court’s office where these deposits are paid.
